A. Personal Identifiers: Directly provided data such as name, business postal address, email address, and telephone number. This is collected primarily via Cal.com when scheduling consultations or through Google Calendar integrations.

B. Audio, Electronic, and Visual Information: To ensure project integrity and "Agentic" accuracy, we utilize Otter.AI and Google Meet to record and transcribe strategy sessions. These recordings are used for internal optimization and meeting minutes. By participating in these sessions, you provide explicit consent for the recording and transcription of your voice and image.

C. Technical and Usage Data: As you navigate through and interact with our Website, we may use automatic data collection technologies (like Google Analytics) to collect usage details, IP addresses, and information collected through cookies and tracking pixels, as well as information about your computer and internet connection, including your operating system and browser type.

3. Detailed Disclosure of Third-Party Sub-Processors

To provide performance marketing services, we share data with the following categories of third-party service providers (Sub-Processors):

• Productivity & Infrastructure: Google Workspace (Data is stored on secure US-based servers).
• Scheduling: Cal.com (Governed by their proprietary privacy standards).
• AI Transcription: Otter.AI (We do not allow Otter.AI to use Client meeting data to train public LLM models).
• Advertising Platforms: Google Ads, Meta (Instagram/Facebook), and TikTok. Note: When we upload "Customer Lists" to these platforms for retargeting, we utilize SHA-256 Hashing to ensure no raw PII is readable by the platform.

4. Cookies and Other Tracking Technologies

We utilize the following categories of cookies:

• Essential Cookies: Necessary for the website to function.
• Performance/Analytics Cookies: Help us understand how visitors interact with the site (Google Analytics).
• Targeting/Advertising Cookies: Used to deliver ads relevant to your interests (Remarketing).

6. Your Rights Under CCPA (California) and GDPR (Europe)

Although we are a Michigan-based LLC, we maintain a global standard of data rights:

• Right to Know/Access: You have the right to request a disclosure of the data we have collected about you over the past 12 months.
• Right to Delete: You may request that we delete personal data, subject to legal requirements.
• Right to Opt-Out of Sale: Mercurial Vision LLC does not sell your personal information. Under the CCPA, "Sale" can be defined broadly; however, we do not provide data to third parties for monetary or other valuable consideration.

7. Data Security and Breach Protocol

Consistent with our Master Service Agreement (MSA), we maintain commercially reasonable technical and physical safeguards.

• 24-Hour Notification: In the event of an actual data breach, we will notify affected Clients within twenty-four (24) hours of discovery.
• Limitation of Liability: Our liability for data breaches is limited to the total fees paid by the Client during the three (3) months preceding the event, as stipulated in our MSA.

8. PHI and HIPAA Exclusion

We strictly avoid accessing Protected Health Information (PHI). We are not a HIPAA-covered entity. Clients are prohibited from sharing PHI with us unless a separate Business Associate Agreement (BAA) is signed by both parties.

9. Geographic Governance

The Website and Agency are operated out of Macomb County, Michigan, USA. If you are accessing our services from outside the United States, please be aware that your information will be transferred to, stored, and processed in the United States.
